Item Description:
The European Commission (hereinafter ’the Commission’ or ‘the contracting authority’), represented by the PMO (‘Paymaster’s Office’ or ‘Office for the Administration and Payment of Individual Entitlements’) has been asked by the institutions, bodies and agencies of the European Union and by the European University Institute, Florence (hereinafter the ‘(insured) institutions’, ‘I/B/As’ or ‘contracting authorities’) to issue an invitation to tender and enter into a framework service contract on behalf of all the parties to provide an insurance policy primarily covering business liability.
Subject of the Contract
The purpose of the business liability insurance is to cover, on the basis of the Belgian law on civil liability and similar provisions in foreign laws, the financial consequences of the extracontractual business liability that the insured persons may incur for any damage caused in the course of their activities.
In particular, the business liability insurance must cover liability arising from the actions, negligence or carelessness of staff and from the movable or immovable property used in the course of their activities, whether within or outside the buildings occupied by the institutions and both during and outside the usual working hours and during work-related journeys.
Cover must be provided worldwide.
The insurance must cover building liability that the insured institutions could incur for buildings located in European Union countries that are used for the purpose of the insured institutions’ activities. In particular, the cover must include damage caused to third parties by the buildings and land that the insured institutions have in their charge and the pavements around these, whatever the nature of the institutions’ association with the building (owner, tenant, long-term tenant, usufructuary, occupant free of charge, etc.).
The contracting authorities declare that almost all of the buildings of the insured institutions are intended to be used as office space.
The insurance must also cover liability for animals in the charge of the institutions, bodies and agencies associated with the procedure and of staff employed by the insured institutions or acting on their behalf, in particular guide dogs.
