Submission of an offer will be taken as your acceptance of all the conditions contained in and attached to the Invitation to Offer.

Your special attention is drawn to Article 15 of the General Conditions of Tender and the fact that the procurement procedure shall be governed solely by the EPO’s own procurement rules. By submitting a bid in response to this invitation to offer, offerors agree that any dispute arising out of or in connection with this invitation to tender shall be exclusively and finally settled by an arbitration tribunal, which shall be set up and shall conduct its proceedings in accordance with Article 15 of the General Conditions of Tender and Annex 2 of the General Conditions of Tender “Rules on Arbitration”.

Please also note the following:

• Expenses incurred by you in preparing and submitting your offer are not refundable.
• Any documents, samples, specimens, etc. submitted by you with your offer will be returned – at your own expense – only if you so request in your offer.
• A contractual relationship will exist only upon signature of a contract.
• The EPO reserves the right not to award a contract.
