Energy Performance Contract on introduction of energy saving activities, thermal modernization of municipal buildings with guaranteed energy savings in the City of Dnipro (reconstruction)
This Invitation for Tenders follows the General Procurement Notice for this project which was originally published on 20 February 2015 and updated on 17 September, 2015 in Procurement Notices on websites of European Bank for reconstruction and Development (“EBRD” or “Bank”).
Municipal enterprise of Dnipro City Council “Dnipro Municipal Energy Management Company” (the “Employer”), has received a loan from EBRD and a grant from the Eastern Europe Energy Efficiency and Environmental Partnership (“E5P grant” or “the grant”), administered by the Bank, towards the cost of the Legal Infrastructure for Energy Efficiency in Dnipro Project.
The Employer now invites potential Contractors (“ESCOs”) to submit their sealed tenders for the following contracts to be funded from the proceeds of the loan and E5P grant:
Lot 1: “Energy Performance Contract on introduction of energy saving activities, thermal modernisation of municipal buildings with guaranteed energy savings in the City of Dnipro(reconstruction)”; Number of school and kindergarten buildings – 39
Lot 2: “Energy Performance Contract on introduction of energy saving activities, thermal modernisation of municipal buildings with guaranteed energy savings in the City of Dnipro(reconstruction)”; Number of school and kindergarten buildings – 45
Potential contractors may submit sealed tenders for any one of the above lots, or both lots.
The objective of the tender is to implement energy efficiency improvement measures in 84 school and kindergarten buildings in Dnipro using the principle of Energy Performance Contracting including but not limited to the following works and services:
Thermal insulation of external walls
Windows replacement
Thermal insulation of ceilings, of basement floors
Heat exchange stations upgrade/replacement
Installation of flow regulators (hydraulic balancing of space heating system)
Installation of heat meters
Thermal insulation of internal heating pipes
Modernisation of internal heating systems (e.g. installation of individually controlled radiators with pre-setting etc.)
Replacement of incandescent indoor lights and adjoining street lights
A new model Energy PerformanceContract (“EnPC”) would be used. The EnPC was developed as part of the preparation of the Bank’s Project.
Activities under the proposed EnPC(s) will include:
To design of energy efficiency measures,
To implement energy efficiency measures,
To provide necessary control and verification of energy savings,
To guarantee operational (energy) cost savings sufficient for repaying the projects’ works (efficiency investments) and services (operations and maintenance) during the period from handover implemented energy efficiency measures to the Employer to 31.12.2027.
Tendering for EnPC(s) to be financed with the proceeds of a loan from the Bank is open to firms from all countries. The proceeds of the Bank’s loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.
Tender documents may be obtained electronically free of charge from the office at the address below. Upon request, the documents will be immediately sent electronically in PDF, MS Word or MS Excel formats.
A two-stage tender will be adopted and will proceed as follows:
(a) the First Stage tender will consist of documents confirming tenderer’s qualification anda technical proposal only, without any reference to prices, containing a list of any deviations to the technical and commercial conditions set forth in the tender documents or any alternative technical solutions a tenderer wishes to offer, and a justification there for, provided always that such deviations or alternative solutions do not change the basic objectives of the project. Following the evaluation by the Employer of the First Stage tenders, the Employer will invite each tenderer who meets the qualification criteria and who has submitted a technically responsive tender to a clarification meeting. The proposals of all such tenderers will be reviewed at the meeting and all required amendments, additions, deletions and other adjustments will be noted and recorded in a Memorandum to the clarification meeting. Only qualified tenderers submitting a technically responsive and acceptable First Stage tender will be invited to submit a Second Stage tender.
(b) the Second Stage tender will consist of an updated technical tender incorporating all changes required by the Employer as recorded in the Memorandum to the clarification meeting or as necessary to reflect any amendments to the tender documents issued subsequent to submission of the First Stage tender; and the commercial tender.
The Employer will evaluate each lot separately and independently of the other lot. Therefore, tenderers who will submit proposals for both lots shall specify technical and commercial proposals separately for each lot; these proposals cannot be mixed. However, tenderers may offer the discount in their letter of tender for each lot for the eventuality of a tenderer being awarded a contract for both lots. The offered discount will be taken into account by the Employer in the evaluation of tenders.
First Stage tenders must be delivered to the address below on or before 6th February, 2017 at 12:00 (local time) at which time they will be opened in the presence of the tenderers’ representatives who wish to attend.
Second Stage tenders must be accompanied by a Tender Security of UAH 260,000 for one lot (either Lot 1 or Lot 2) or UAH 520,000 for both lots. Tender Security might also be submitted in equivalent in convertible currency at the exchange rate published by the National Bank of Ukraine on the date is issuance, and must be delivered to the address below on or before the time and date of the submission deadline specified in the Letter of Invitation to submit Second Stage tenders. At indicated time and date they will be opened in the presence of the tenderers’ representatives who wish to attend.
