    Item Description:

    Consultancy services for the supervision of rehabilitation works on М-06 Kyiv – Chop road km 129+600 – 151+730 (Zhytomyr bypass) in a capacity of the Engineer

    This request for expressions of interest follows the updated General Procurement Notice No. 7969-GPN-40185 for this project published on the EBRD’s web-site on 1 December 2016.

    The State Road Agency of Ukraine (Ukravtodor) has received financing from the European Bank for Reconstruction and Development and European Investment Bank toward the cost of the Pan-European Corridors Project (the “Project”) and intends to apply the proceeds to payments for consulting services for the Supervision of the civil works (rehabilitation works on М-06 Kyiv – Chop on the section of Zhytomyr bypass) in a capacity of the FIDIC Engineer.

    The works to be carried out include the rehabilitation of one section of M-06 Road (22.1 km long) and include roads, bridges, earth fill and ancillary works.

    The works are situated to the west of Kiev and follow the line of the existing northern bypass of Zhytomyr on M-06 Kyiv – Chop road.

    Ukravtodor requires the following services to be performed under this assignment, but not limited to:

    the Engineer’s administration of contract,
    Carrying out checks on the contractors’ setting out and ensuring that the works are carried out in accordance with the approved design details,
    Ensuring that the works are executed in accordance with all provisions of the contracts, including those relating to standards of workmanship, other safety requirements and environmental protection requirements,
    Provide continuous monitoring of contractor’s schedules and its modifications, quality of equipment/materials, compliance with environmental requirements, etc.,
    Measuring the works, agreeing and issuing interim and final payment certificates for payment by the Employer,
    Issuing site instructions, variation orders and day works orders, as appropriate,
    Maintaining regular estimates of the cost to completion and time to completion for the contract,
    Reviewing and agreeing with the Employer, as appropriate, the contractors’ work program and method statements and modifications thereof and subsequently monitoring the construction progress in accordance with contract requirements,
    Reviewing and approving, as appropriate, the contractors’ key staff, insurances, guarantees, licenses, traffic management plans, safety measures,
    Maintaining the quality assurance and control system and execution of the testing program,
    Approving the subcontractors, plant, equipment
    Organizing the necessary meetings at the construction site and to prepare the minutes of meetings and to monitor and supervise the implementation of the final decisions taken in the meetings,
    Establish the list of defects or damages or review the list of defects or damages and provide recommendation on the measures for its elimination, and
    Approve the tests and correction measures, which are needed for defects elimination, if they appeared during defect notification period;
    Regular reporting to the client.
    The Employer invites expressions of interest from suitably qualified firms who are interested in providing the supervision of the civil works and carrying out the duties of the Engineer in accordance with the contract for the above works, which will be based upon FIDIC MDB Harmonized Edition of the Conditions of Contract for Construction, March 2010.

    Assignment Start Date and Duration: The assignment is expected to commence from the moment of signing of the Agreement (approximately in April 2017). The estimated time for implementation of supervision services shall be three years, with two years for construction period, and one year for defects notification period.

    Funding Source: EBRD, EIB.

    Eligibility: Procurement will be open to firms and joint ventures of firms from any country, except for those consultants, who are on the EBRD’s list of ineligible entities. The proceeds of the loan shall not be used for the purpose of any payment to persons or entities or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations and the Client’s Country prohibitions.

    Status: in order to determine the capability and experience of consulting firms seeking to be short-listed, the information submitted shall include:

    Company profile, organization and staffing;
    Details of experience or similar assignments undertaken in the previous five years, including their locations (the information submitted shall include for each project, as a minimum, the following:
    project title;
    contractual role of the firm;
    the presence of any affiliate or parent companies and their respective roles;
    location, start and completion dates;
    value;
    name of the Client;
    funding source, objectives and brief narrative description of the project;
    functions and tasks carried out;
    applicable national and/or international codes and standards, and certification.

    The consulting firms seeking to be short-listed, requires having the following experience:

    International and regional experience in supervision under FIDIC contracts conditions in road sector, as well as on work on the projects financed by international financing institutions.
    Procurement procedure: Procurement of the consultancy services will be conducted through the procedures as specified in the EBRD’s Procurement Policies and Rules (PP&R) dated May, 2014. The consultants will be selected under quality and cost based selection procedure.

    A shortlist of qualified consultants will be prepared based on the response to this invitation, after which short-listed firms will be invited to submit their proposals.

    If the consultant has been found by a judicial process or other official enquiry to have engaged in any of the Prohibited Practices as defined in the EBRD PP&R, details of the basis for the outcome of such process or enquiry shall be provided with the expression of interest.

    The Employer reserves the right not to shortlist consulting firms that have been found to have engaged in corrupt or fraudulent practices regardless of the results of technical evaluation of the expressions of interest.

    If a firm considers it does not possess all the required expertise for the assignment, it may consider forming a consortium with other firms. In such cases the Expression of Interest should provide the aforementioned details for each partner and an indication which firm is the lead partner.

    The above information should not exceed 30 pages.

    The shortlist criteria are as follows:

    (a) Consultants’ previous experience in works contract supervision of similar projects – 40%

    (b) Consultants’ previous experience with supervision of works in accordance to FIDIC conditions of contract – 50%

    (c) Consultants’ previous project experience with the assignments carried out under the procurement policies and rules of MDB, such as the EBRD, World Bank or others) – 10%

    Interested consultants may obtain further information at the address below during office hours from 8:00 a.m. to 5:00 p.m. (local time).

    Three (3) copies of the above required information in Ukrainian and one (1) copy in English should be submitted to the address below in a sealed envelope marked as «Expression of Interest for the Pan-European Corridors Project/European Roads Ukraine II: Consultancy services for the supervision of construction works on М-06 Kyiv – Chop (Zhytomyr bypass) in a capacity of the FIDIC Engineer» and shall be delivered in a printed form to the address below (in person, or by mail) before 16:00 (Local time) December 23, 2016.

    Please note that submission of Expressions of Interest that do not comply with these requirements may be rejected.

    Expressions of interest received after this time and date may not be considered and may be returned unopened.
