Item Description:
United Nations Office at Nairobi (hereinafter referred to as UNON) on behalf of the United Nations Human Settlements Programme (UN-Habitat) is seeking to establish Contract of a period not exceeding 6 months with a qualified consulting firm to provide consultancy services to conduct institutional capacity assessment and research on land conflict/dispute mapping in target areas the districts in Hirshabelle State, Jubaland.
The consulting firm will be expected to perform including but not limited to:
- Review law and practices and conduct analysis on potential entry points and promising practices affecting land administration, land management and issues affecting tenure rights in the identified districts (districts for research will be identified in conjunction with project manager) including a status report on current formal and traditional and religious judiciary institutions;
- Summarize institutional land governance issues at local governments and regional state authorities level and point out key challenges and opportunities;
- To identify and document the land issues/dispute cases common and widespread in Galmudug and Hirshabelle states, and to assess current processes of mediation and arbitration, and consider the appropriateness of these mechanisms to resolve land claims in in these two states. Assess the process of negotiation, with a focus on government’s policies on land claims/disputes;
- Conduct thorough conflict analysis and prepare written report on the findings and recommendations;
- To analyze the specific local dispute resolution processes which have been employed to resolve the land dispute in the regions and make recommendations/suggestions to improve these various processes where applicable;
- To highlight good practices, identify gaps and capacity challenges with regards to local land dispute resolution;
- To review land tenure and security situations and present threats against various communities, for example IDP, returnee communities or other marginalized groups and the opportunities to mitigate;
- Identify and document innovative and relevant local practices to manage land dispute management, land allocation and registration procedures and suggest viable and acceptable methods to improve it and / or scale it up;
- Facilitate consultations and discussions on land governance functions and institutionalization of the land dispute adjudication procedures, ensure coordination with other projects in the Somalia Country Programme, primarily Midnimo II;
- Organize findings and recommendations to validate and get the buy-in at local level and state level with relevant Ministries, and translate recommendations into a workplan and strategy to strengthen local authorities to address land management and dispute issues.
