Item Description:
The European Banking Authority (referred to below as the “contracting authority”) is planning to award a framework contract with multiple service providers resulting from the above procurement procedure. The procurement documents for this procedure consist of the contract notice, the invitation letter, the draft framework contract and tender specifications with their respective annexes. All documents are enclosed in the attached ZIP File.
The Authorities wish to procure language learning and testing for its personnel to:
- Enable colleagues to demonstrate a working knowledge of a third official EU language. Under the Staff Regulations1 of the EU institutions, bodies and agencies, personnel must demonstrate their ability to work in a third official EU language before their first promotion after recruitment. To this end, the EBA is responsible for supporting language learning and assessment of language skills to ensure that the rules are applied in a standard and consistent manner within the of Common European Framework of Reference for Languages further referred to as Common European Framework of Reference for Languages.
- Improve communication in the language of the place of employment. Due to the location of the Authorities, French language plays an important role. Therefore, the Authorities will offer French language training to its staff to help their integration in France.
- More broadly to improve linguistic and cultural understanding among the Authorities’ multicultural and multilingual staff.
Legal effects of the invitation to tender and submission of a tender.
This invitation to tender is in no way binding on the contracting authority. The contracting authority’s contractual obligation commences only when the framework contract with the successful tenderers are signed by both parties.
Up to the signature of the framework contract the contracting authority may cancel the procurement procedure without tenderers being entitled to claim any compensation. Any such decision must be substantiated and tenderers notified.
The validity period of the tender, during which tenderers may not modify the terms of their tenders in any respect, is indicated under Heading IV.2.6 of the contract notice.
Submission of a tender implies acceptance of all the terms and conditions set out in the procurement documents and, where appropriate, waiver of the tenderer’s own general or specific terms and conditions. The submitted tender is binding on the tenderer to whom a framework contract is awarded for the duration of the framework contract.
