Framework Contract for the Provision of Consultancy Services during the Competitive Dialogue for the Procurement of a Works Contract for the Permanent Premises of FRONTEX

Item Description:

The European Border and Coast Guard Agency Frontex (hereinafter referred to as “Frontex” or “the Agency) was established in 2005 to assist both EU member states and other countries within the Schengen passport-free area in the management of their external borders and to bring greater consistency and harmonization to EU border control. The Agency facilitates cooperation between border and coast guard authorities by providing the necessary technical support and expertise available where and when it is needed. Frontex promotes, coordinates and develops European border management in line with the EU fundamental rights charter applying the concept of Integrated Border Management. Subject of the contract

This procurement procedure aims to conclude a contract for the provision of Technical Advice and Assistance (TA) services during the Competitive Dialogue for the Design & Build contract for Frontex Permanent Premises. Frontex intends to conclude a Service Contract with a Contractor that will provide, through a group of experts, expertise in sustainable building design, construction, operations and maintenance (O&M). The Contractor shall also provide risk and quality assurance assistance of the procurement deliverables by the necessary (administrative) assistance during the procedure of the Competitive Dialogue, all in close liaison with TF BUILD.

Most tasks will be performed, in principle, extra muros at the Contractor’s premises, due to Covid-19. Most meetings will take place by remote videoconference/conference call sessions apart from some site visits to Racławicka Street 136 in Warsaw. In case in-person negotiations take place during the Competitive Dialogue, the Contractor will be invited to the Frontex premises. Nonetheless, hybrid meetings (with some participants attending physically and others virtually) will be possible whenever required.

The overall objective of the contract is to assist the Evaluation Committee and Frontex negotiation team(s) in conducting the tender procedure for the Frontex Headquarter project in line with best practices in public procurement. In view of the high standards set in terms of sustainability and other performance requirements, the Contractor will provide expertise in many aspects of state-of-the-art office building design, construction methodologies, O&M, facility management and risk & quality assurance in order to advise Frontex in the selection of the most advantageous tender for the design and construction of Frontex future premises.

The tenderer shall be in a position to provide all services requested under the Framework Contract.

Scope and type the contract

The subject of the framework contract is the provision of consultancy services, as described in these Terms of Reference. The scope of the tender is the provision of Technical Advice and Assistance (TA) during the Competitive Dialogue procedure for Frontex Headquarters.

The envisaged contract is a single Framework Contract with one contractor, as described in Annex I. Frontex may conclude a contract with the awarded tenderer on the basis of the draft contract included in Annex V to the Invitation to Tender.

In parallel, Frontex has signed a service contract with a Legal Firm covering assistance in the legal aspects of the procedure.
