Item Description:

This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Project Procurement Notices on 17 January 2018 and recently updated on March 8, 2019.

Procurement will be carried out in accordance with the EBRD “Procurement Policies and Rules” (PPR), which are published on the Bank’s website.

Municipal institution (legal form under Tajik legislation) „Housing and Municipal Production and Operational Department of Yavan City” (in Tajik PAЁСATИ КОММУНАЛИ – ИСТЕХСОЛИ ВА ИСТИФОДАИ МАНЗИЛИИ ШАХРАКИ ЁВОН“), which was established by Yavan District on 20 February 1997, Tax ID. No. 400000781, hereinafter referred to as “the Employer” or “the Client”, has received a loan from the European Bank for Reconstruction and Development, hereinafter referred to as “the Bank”, and intends using part of the proceeds towards the cost of Yavan Solid Waste Project, hereinafter referred to as “the Project”.

The Client now invites tenders for the following contract(s), hereinafter referred to as “the Contract”, to be funded from part of the above proceeds:

YSWP03  Collection Points Works (total 58, of which 23 for reconstruction and 35 new)

Tendering for contracts to be financed with the above proceeds is open to firms and individuals from any country.

To be qualified for the award of a Contract, tenderers must substantially satisfy the following minimum criteria, also stated in the Tender Document:

1. Average Annual Turnover

The Tenderer must demonstrate minimum average annual construction turnover of USD 60,000.00 (sixty thousand USD), calculated as total certified payments received for contracts in progress or completed, within the last three [2016, 2017, 2018] years.

The lead partner of a JVCA shall meet 70% of this requirement. Each other partner shall meet not less than 30% of this requirement.

2. Experience

Experience in the role of of Contractor, in at least 2 (two) contracts within the last 5 (five) years, each with a value of at least USD 20,000.00 (twenty thousand), that have been successfully and substantially completed and that are similar to the proposed works. The similarity shall be based on the nature and complexity of the works compared with the works described in Section V: Requirements.

The lead partner of a JVCA shall demonstrate successful experience in at least one contract of similar nature and magnitude.

3. Historical Contract Non-Performance

The Tenderer, or any partner in a JVCA, shall not have a consistent history of litigation and/or arbitration resulting in awards against the Tenderer, or any partner in a JVCA, within the last 3 (three) years, namely 2016-2018.

This determination shall be based solely on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective Contract, and where all appeal instances available to the Tenderer have been exhausted.

All pending litigation shall in total not represent more than twenty percent (20%) of the Tenderer’s net worth and shall be treated as resolved against the Tenderer.

The Tender Document, upon request, will be dispatched electronically free of charge.

Tenders must be duly completed and submitted to the Client on or before 31 January 2020, 14:30 hrs Dushanbe time, at which time they will be opened in the presence of those Tenderers’ representatives who choose to attend.
