Construction of waste collection points and reconstruction and extension of company garage with diesel station

Item Description:

This Invitation for Tenders follows the General Procurement Notice for this project which was published on European Bank for Reconstruction and Development (the Bank) website, Procurement Notices (http://www.ebrd.com) on 05 August 2019.

Communal Enterprise “Shubai Manziliyu Kommunali va Khojagidori Dar Nazdi Makomoti Ijroiyai Hokimiyati Davlatii Shahri Tursunzoda” of Tursun-Zade City, hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the Bank towards the cost of the Tursun-Zade Solid Waste Project.

The Employer now invites sealed tenders from contractors for the following Contracts to be funded from part of the proceeds of the loan and grand:

Construction of waste collection points and reconstruction and extension of company garage with diesel station:

Lot 1: “Construction of waste collection points”. This contract includes construction of 46 collection points in the City of Tusun-Zade. The collection points will be concrete structures with walls on three sides and will have place for 5 pieces of 600 l metal containers. The estimated completion time under the contract is 180 calendar days. The completion is followed by a Defects Notification Period of 365 days.

Lot 2: “Diesel station”. This contract includes installation of a diesel station in the company garage and constructing a related depo. The estimated completion time under the contract is 180 calendar days. The completion is followed by a Defects Notification Period of 365 days.

Lot 3: “Reconstruction and extension of company garage”. This contract includes refurbishment, asphalting and extension of the company garage. The estimated completion time under the contract is 180 calendar days. The completion is followed by a Defects Notification Period of 365 days.

Tenders are invited for one or more lots. Each lot must be priced separately.  Tenders for more than one lot may offer discounts and such discounts will be considered in the comparison of tenders.

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country.
To be qualified for the award of a Contract, tenderers must satisfy the following minimum criteria:

• Minimum average annual construction turnover calculated as total certified payments received for contracts in progress or completed, for 2016 – 2018 years of:
  • Lot 1: USD 210 000;
  • Lot 2: USD 100 000;
  • Lot 3: USD 470 000

Tenderers wishing to apply for more than one lot have to fulfil the combined requirements, e.g. for all three lots 780 000 USD.

• The Tenderer must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the following cash-flow requirement:
  • Lot 1: USD 60 000;
  • Lot 2: USD 30 000;
  • Lot 3: USD 85 000

and the overall cash flow requirements for this Contract and its current commitments.

Tenderers wishing to apply for more than one lot have to fulfil the combined requirements, e.g. for all three lots 175 000 USD.

• General Experience: Experience under contracts in the role of contractor or management contractor for the last three (3) years, i.e. 2016 – up to the tender closing date, and with activity in at least nine (9) months in each year.
• Specific experience:
  1. Participation as contractor or management contractor in at least two (2) contracts within the last three (3) years, i.e. 2016 – up to the tender closing date, that have been successfully and substantially completed and that are similar to the proposed Works. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Section VI, Employer’s Requirements.  The value of each of the referred contracts shall be not less than:
     • Lot 1: USD 50 000;
     • Lot 2: USD 25 000;
     • Lot 3: USD 100 000

that have been successfully and substantially completed and that are similar to the proposed Works. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Section VI, Employer’s Requirements.

For successful experience cumulative requirements as Contractor could be demonstrated by separate contracts or by contracts of higher value in which case 2 contracts per lots won’t be necessary if such contract’s value equals a sum of few contracts requirements.

Tenderers wishing to apply for more than one lot have to fulfil the combined requirements, e.g. for all three lots 175 000 USD.

2. For the above or other contracts executed during the period stipulated in 2.4.2(a) above, a minimum experience in the following key activities:
   • Lot 1: Construction of reinforced concrete walls, floor plates and foundations of at least 1 000 m³ in total in the last three years.
   • Lot 2: installation of diesel station with minimum at least 8m3 tank.
   • Lot 3: Minimum of two industrial / office buildings with a volume of at least 5 000 m³ in total including one industrial building of minimum at least 2 500 m³ in the last three years. Steel or wooden constructions will not be accepted.

• The Tenderer, or any partner in a JVCA, shall not have a consistent history of litigation and/or arbitration resulting in awards against the Tenderer, or any partner in a JVCA, from 2016 and till the tender submission deadline. This determination shall be based solely on fully settled disputes or litigation.  A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective Contract, and where all appeal instances available to the Tenderer have been exhausted. All pending litigation shall in total not represent more than 20% (twenty percent) of the Tenderer’s net worth and shall be treated as resolved against the Tenderer.
• Joint ventures, consortiums or associations (JVCA) shall meet the following minimum qualification requirements:
  • The Lead Partner shall meet at least 70% of the minimum qualification criteria for average annual turnover and financial resources; and demonstrate successful specific experience as Contractor  in at least one similar contract;
  • Each partner of JVCA shall meet at least 30% of the minimum qualification criteria for average annual turnover and financial resources;
  • All partners shall be jointly and severally liable;
  • Lead partner (a Representative) shall have the original of power of attorney as authority to conduct all business for and on behalf of any and all the partners of the joint venture/consortium during tender process and, in the event of the Contract, during contract execution.
• The Tenderer must submit with its tender copy of its license(s) valid in Tajikistan to execute the necessary construction works required by the contract or evidence that the license(s) would be obtained by the time of signing the contract. The term of the license(s) must remain valid until the planned date of completion of the contract.
