    Item Description:

    The Publications Office of the European Union, hereinafter referred to as ‘the Publications Office’ (2, rue Mercier, L-2985 Luxembourg, LUXEMBOURG) is the publishing house of the European Union institutions in the broadest sense, responsible for publishing and distributing, in all media and by all means, of all the publications of the EU. The Publications Office, the current organisation and operation of which are laid down by Decision 2009/496/EC, Euratom (Official Journal of the European Union, L 168, 30.6.2009, p. 41, as amended), is managed by a Management Committee, on which each institution is represented by its Secretary-General. The Publications Office is administratively attached to the European Commission (‘the contracting authority’).     As a publisher, the Publications Office has a duty to offer the highest quality of service to its customers – the originating departments of the institutions and other bodies of the European Union – and to its public – people in the EU and throughout the world who are interested in European affairs. In the field of new technologies, the Publications Office must place itself at the forefront of the publishing profession.

    Under the provisions of the Treaty on European Union, the publication of certain titles, such as the Official Journal of the European Union and the General Report on the Activities of the European Union, is a legal obligation.

    Nature of the contract

    The contract is a multiple framework service contract in dynamic cascade (‘the FWC’) with the following title: Language editing of documents in English.

    As exact implementing conditions, quantities and delivery times cannot be indicated in advance, the contracting authority intends to conclude an FWC, which shall establish the basic terms for a series of order forms and specific contracts (hereafter collectively referred to as ‘orders) to be issued over its duration. The FWC does not give rise to any direct obligation on the part of the contracting authority; it is only its implementation through orders that is binding on the part of the contracting authority.

    The FWC shall be concluded in the form of separate but identical FWCs with five (5) economic operators at most (provided that there are enough economic operators that are not excluded) that satisfy the selection criteria and the award criteria. For more details, please refer to point 2.9 of the specifications.

    The successful tenders will be ranked in descending order with a view to establishing a list of contractors and a sequence in which they will be offered work when orders are placed. In accordance with Article I.4.1 of the FWC, the Publications Office will review the order of the cascade regularly by taking into account the performance of the contractor concerned as described in point 4.10 of these specifications. The update will be carried out on a monthly basis provided there are changes in the ranking, and if so the contractors will be duly informed by the Publications Office.

    In the event of tasks within the scope of the FWC that are not listed in the price schedule, competition between the contractors may be reopened. For more details see point 4.1.8 of the specifications and Article I.4.3.2 of the FWC.

    The FWC will be concluded in English. All formal communication related to the FWC and its implementation will be done in the language of the FWC.
